Terms of Service

1. Introduction

These terms govern your use of hwswapandshop.com ("HW Swap and Shop," "we," "us," or "our"). By accessing or using our platform, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the platform.

2. Accounts

You must be at least 18 years old to create an account on HW Swap and Shop. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Each person may only maintain one account. We reserve the right to suspend or terminate accounts that violate these terms.

3. Seller Subscriptions

To create and manage listings, you must subscribe to a Seller account at $10 per month. Subscriptions are billed monthly through Stripe and renew automatically until cancelled. You may cancel your subscription at any time through the billing settings in your dashboard. Refunds are not provided for partial billing periods. Your listings will remain active until the end of your current billing cycle after cancellation.

4. Listings

Sellers are solely responsible for the accuracy of their listings, including titles, descriptions, pricing, and condition grades. Photos must depict the actual item being offered for sale. Listings for counterfeit, stolen, or prohibited items are not allowed. HW Swap and Shop reserves the right to remove any listing at our discretion without prior notice.

5. Offers & Transactions

HW Swap and Shop provides a platform for connecting Hot Wheels buyers and sellers. When a buyer purchases an item through Buy It Now, payment is processed securely through Stripe. For offers and trades, buyers and sellers communicate and arrange terms independently. HW Swap and Shop is not a party to transactions between users and is not liable for disputes, non-delivery, item condition disagreements, or any other issues arising between buyers and sellers.

6. Prohibited Conduct

You agree not to:

• Post fraudulent, misleading, or deceptive listings
• Harass, threaten, or abuse other users
• Send spam or unsolicited commercial messages
• Create fake accounts or impersonate other users
• Manipulate offers, reviews, or any other platform features
• Use the platform for any illegal activity, including the sale of stolen goods
• Attempt to circumvent platform fees or payment processing

7. Content

You retain ownership of all photos, text, and other content you submit to HW Swap and Shop. By posting content on the platform, you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content in connection with operating and promoting the platform. This license ends when you delete your content or your account.

8. Limitation of Liability

HW Swap and Shop is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the platform will be uninterrupted, secure, or error-free. To the fullest extent permitted by law, HW Swap and Shop shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform or any transactions between users.

9. Termination

We may suspend or permanently ban accounts that violate these Terms of Service at our sole discretion. Upon termination, your right to use the platform ceases immediately. Any active listings will be removed. If you have an active subscription, it will be cancelled and no refund will be issued for the remaining billing period.

10. Changes to These Terms

We may update these Terms of Service from time to time. Changes will be posted on this page with an updated revision date. Continued use of the platform after changes are posted constitutes your acceptance of the revised terms. We encourage you to review this page periodically.
